NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS CONTEST. A PURCHASE OR PAYMENT WILL NOT INCREASE OR IMPROVE YOUR CHANCES OF WINNING.
1. CONTEST ORGANIZER: The Canadian Mountain Holidays LP “CMH Lines of Sight Tour/Utah Hockey Club Giveaway 2025” (the “Contest”) is sponsored by Canadian Mountain Holidays LP (“Contest Organizer”) and the address at which Contest Organizer may be contacted is 217 Bear Street, Box 1660, Banff, AB, Canada T1L, 1J6. Neither The Utah Hockey Club nor the Delta Center is a sponsor or administrator of the Contest, the Contest is in no way endorsed or administered by either of them, and neither of them shall have any responsibility of liability with respect to the Contest. Contest Organizer is offering the Contest in conjunction with the CMH Lines of Sight Tour event at the Utah Hockey Club vs. Pittsburgh Penguins game to take place on January 29, 2025 (the “Event”) at the Delta Center located at 301 S. Temple, Salt Lake City, Utah 84101. In the United States, the Contest shall be known and governed as a sweepstakes.
2. ELIGIBILITY: The Contest is only open to entrants who, as of the date of entry, are: legal residents of Canada (excluding residents of the Province of Quebec) or the fifty (50) United States (excluding Rhode Island) or the District of Columbia, 19 years of age or older. This Contest is void outside of eligible territories (including in Quebec and Rhode Island). Employees, officers and directors of Canadian Mountain Holidays LP, Canadian Mountain Holidays Inc., Intrawest ULC, the Utah Hockey Club, the Delta Center, and all of their respective parents, affiliates (including, without limitation, division), subsidiaries, advertising and promotion agencies, and suppliers, (collectively the “Employees”), and immediate family members (defined as spouses, parents, children, siblings grandparents, and their respective spouses) or members of the same household (whether related or not) of each such Employee, officer or director, are not eligible to enter. The Contest is subject to all applicable federal, provincial, state and local laws and regulations. The Contest, and any website pages and advertisements relating thereto, is intended for viewing only within Canada or the fifty (50) United States or the District of Columbia, and entrants must be present in the United States at the time they enter.
3. ENTRY PERIOD: The entry period for the Contest shall commence on Wednesday, January 29, 2025 at 4:00pm Mountain Time (“MT”) and continue until 7:00pm MT on Wednesday, January 29, 2025 (the “Entry Period”). Entries received other than during the Entry Period, and duplicate entries, will be determined ineligible and will be discarded. Contest Organizer’s computer is the official timekeeper for the Contest.
4. HOW TO ENTER: The purchase of a CMH heli-trip is not a requirement to enter the Contest and the purchase of a CMH heli-trip will not increase your odds of winning. You may only enter the Contest in person at the Event during the Entry Period by: (a) visiting the Contest booth at the Event and scanning the QR code to sign up for the Contest using your smartphone, (b) clicking the link generated by the QR code, (c) completely filling out the online entry form and providing the required information, including your name, physical address, and email address, (d) either checking the box where indicated to expressly opt in to receiving the CMH Newsletter from Contest Organizer or leaving the box unchecked in order to decline receiving such newsletter from Contest Organizer, and (e) submitting the entry form in accordance with the on-screen instructions. Failure to properly or fully complete the entry form will void your entry and each participant is solely responsible for properly and fully completing the form. This is the only way to enter the Contest; no mail or email entries will be accepted. ENTRANTS MUST ENTER IN ACCORDANCE WITH THESE OFFICIAL RULES. NO OTHER METHOD OF ENTRY WILL BE ACCEPTED.
5. FOR ALL ENTRIES: LIMIT: One (1) entry per person. Any person found entering the Contest using more than one e-mail address will be disqualified. Any entries attempted through the use of agencies or robotic, repetitive, automatic, programmed or similar methods will be void. In the event of a dispute as to the identity of any entrant, the authorized account holder of the e-mail address associated with the entry will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an e-mail address by an internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. Potential winner may be required to show proof of being the authorized account holder. All entries become the exclusive property of Contest Organizer and none will be acknowledged or returned. Proof of submission will not be deemed to be proof of receipt of entry by Contest Organizer. All entrants and entries are subject to verification prior to the awarding of a prize, as are the eligibility, agent and other claims of/information provided by a potential prize winner. Entrants will cooperate with Contest Organizer and its representatives in connection with any and all verification activities. All entries that are incomplete, illegible, damaged, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of the Official Rules (defined below) may be disqualified by Contest Organizer. Contest Organizer takes no responsibility for lost, stolen, delayed, damaged, misdirected, late or destroyed entries, or for typographical or other production errors. Contest Organizer is not responsible for any errors or omissions in printing or advertising the Contest.
6. AGREEMENT TO OFFICIAL RULES AND DECISIONS: The Contest will be run in accordance with these Official Rules, subject to amendment by Contest Organizer (the "Official Rules"). Entrants must comply with the Official Rules and will be deemed to have received and understood the Official Rules by participating in the Contest. The terms of the Contest, as set out in the Official Rules, are not subject to amendment or counter-offer, except as set out herein. Contest Organizer's decisions with respect to the Contest (including, without limitation, decisions regarding eligibility of entries, the selection of entrants and winner, and awarding of the Prize) are final and binding.
7. PRIZE DRAWING; ODDS; NOTIFICATION:
a. Prize Drawing; Odds. WINNER NEED NOT BE PRESENT TO WIN. Within twenty-four (24) hours of the close of the Entry Period, one (1) winner will be drawn at random from all eligible entries received during the Entry Period. Odds of winning depend on the total number of eligible entries received.
The Prize will be awarded through a random drawing run by computer software from all eligible entries that will be conducted by a Contest Organizer representative. The Prize will be awarded by Contest Organizer whose decisions are final on all matters relating to the Contest.
b. Notification. The potential winner selected must comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements set forth herein. The potential winner will be notified by phone or email within twenty-four (24) hours of the Event. The potential winner and potential winner’s guest will be required to execute and return to Contest Organizer a notarized Affidavit of Eligibility, a Liability Release, and, except where prohibited by law, a Publicity Release (collective, an “Affidavit/Release”) in the form(s) provided by Contest Organizer in order to claim his/her prize. The Affidavit/Release must be returned to Contest Organizer by the date and/or time indicated within the Affidavit/Release. A potential winner who is a resident of Canada will also first be required to correctly answer, without assistance of any kind whatsoever mechanical or otherwise, a mathematical skill-testing question in no more than five (5) minutes, the test to be administered by telephone, to be eligible to win the prize. If the potential winner cannot be contacted within seventy-two (72) hours of the first attempt to contact him/her, or if a potential winner who is a resident of Canada fails to correctly answer the skill testing question in the manner prescribed, or if a potential winner cannot be contacted within seventy-two (72) hours of the first attempt to contact him/her, or if a potential winner and/or potential winner’s guest fails to return the Affidavit/Release within the specified time, or if any prize or prize notification is returned as undeliverable, or if a potential winner is found to be ineligible, or if a potential winner does not comply with these Official Rules, then the potential winner may be disqualified and an alternate potential winner selected by Contest Organizer in his/her place at random from among all eligible non-winning entries received by Contest Organizer for the Contest. In such event, an alternate potential prize winner will be notified as described above and will be required to return the required documents to Contest Organizer as described above; provided, however, Contest Organizer may alter the above timing to meet its Contest schedule. Contest Organizer is not responsible for the failure of a potential winner to receive the required documents for any reason, or for the inability of such potential winner to return the required documents for any reason. The winner agrees that he/she will not conduct or participate in any media interview regarding this Contest or any prize without the express prior written permission of Contest Organizer.
8. PRIZE/PRIZE REDEMPTION:
a. Subject to the terms and conditions of these Official Rules, one (1) prize will be awarded in this Contest (the “Prize”). The prize consists of and is limited to: a CMH Purcell Signature Two Day Heli-Skiing Trip for winner and one (1) guest at Canadian Mountain Holidays Purcell during the 2024-25 ski season, with an approximate retail value (“ARV”) of $4,710 CDN. Prize includes:
- A light morning bite, lunch in the field and apres-ski snacks
- Services of our fully certified guides
- Training in and use of custom heli-skis and avalanche transceivers
- Use of ski poles/radio/shovel/probe/guest pack
Except as set forth in 8b. below, the CMH Purcell Heli-Skiing Trip must be booked by March 15, 2025 and completed by April 15, 2026 (blackout periods do apply).
If a trip of lesser value is booked, no refund will be issued. The Prize is valid for a new booking only and cannot be used as payment for an already existing booking.
The winner will be notified of how to redeem the Prize and will be responsible for booking airfare and accommodations prior to and following the trip. Arrangements are all subject to space availability. Once confirmed, accommodation arrangements cannot be changed.
b. The Prize is subject to these additional requirements and restrictions: Winner’s guest must, as of the date of travel, be a legal resident of Canada or the fifty (50) United States or the District of Columbia and nineteen (19) years of age or older. Each of winner and winner’s guest will be responsible for all costs, expenses and incidentals that are not specifically stated as being included in the Prize, including but not limited to, airfare, accommodations before and following the trip, personal items, food, alcohol purchases, CMH shop purchases, gratuities, taxes, and insurance. Each of winner and winner’s guest is responsible for ensuring that he/she has any and all required travel documentation and identification, including passports and visas as applicable, and to ensure that such travel documentation or identification is valid prior to and for the entire duration of travel, and to comply with any customs and immigration requirements. The Prize activities, including, without limitation, heli-skiing, are subject to weather, safety and other similar limitations and restrictions, as well as the duration of the 2024-25 ski season, which may be affected by many factors, including but not limited to, snow conditions, runs open, unusually harsh weather, pandemic or epidemic, travel advisories, public health or government order, or any other event or occurrence, as determined by Contest Organizer in its sole discretion, which may result in limitation of Prize and/or which may limit or prohibit Canadian Mountain Holidays from conducting its operations. In the event of any such impacts on the use of a Prize, no cash or other consideration will be provided to winner, but winner may reschedule his/her use of the Prize to the 2025-26 ski season. No compensation of any kind other than this optional rescheduling will be provided under any circumstances whatsoever and the Prize will expire and be forfeited if no such rescheduling is booked prior to April 15, 2026 and only one (1) such rebooking will be permitted. It is recommended that each of winner and winner’s guest obtain sufficient personal travel insurance prior to departure. If winner and/or winner’s guest decides not to travel due to reasons other than the foregoing, the prize will be forfeited, no alternative prize will be awarded, and no credit or reimbursement will be awarded. Contest Organizer will not replace lost or stolen travel documents.
Prize is nontransferable, nonassignable, nonnegotiable, and not redeemable for cash or credit, except as otherwise provided in these Official Rules. Prize must be accepted as awarded. To the fullest extent permitted by applicable law, the Prize is awarded “AS IS” with no warranty, condition, representation, or guarantee, express or implied, in fact or in law, made by Contest Organizer or for which Contest Organizer shall be liable, including, without limitation, ANY IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, NON-INFRINGEMENT OR FITNESS FOR A PARTICULAR PURPOSE AND WINNER ASSUMES ANY AND ALL RISKS OF USING THE PRIZE, INCLUDING PERSONAL INJURY, PROPERTY DAMAGE OR DEATH. No prize substitutions, except by Contest Organizer, who reserves the right (but has no obligation) to substitute a prize (or a component thereof) with another prize of comparable or greater value (including cash) if the Prize (or a component thereof) is not available for any reason as determined by Contest Organizer in its sole discretion. Unused components of a prize shall be forfeited and have no redeemable cash value. Winner is solely and fully responsible for any and all costs, fees, taxes, assessments and expenses associated with prize award, redemption, receipt and use not specified in the prize description above, including, without limitation, all international, federal, provincial state, and local taxes on such prize. If applicable, winner will be issued an IRS Form 1099 (or Canadian equivalent) for the actual retail value of the Prize. Winner waives the right to assert as a cost of winning a prize any and all costs of verification and redemption or travel to redeem the Prize. Non-compliance with any of the foregoing and any other condition of this Contest may result in disqualification and forfeiture of prize, in which case, no consideration will be awarded.
Prize is also conditional on winner and winner’s guest signing CMH’s standard Release of Liability, Waiver of Claims, Assumption of Risk, Warning, Indemnity and Consent to Medical Treatment Agreement (“Waiver”) no later than 30 days prior to the first day of their trip, after which date winner will forfeit their Prize. Should winner and/or winner’s guest refuse to sign the Waiver prior to the trip, they will be unable to join the trip and they will not be entitled to any other compensation from CMH as a result of such cancellation.
9. PUBLICITY: Except where prohibited by law, acceptance of a prize constitutes a winner’s consent to Contest Organizer’s (and its successors’ and assigns’) use of a winner’s name, biography, likeness, voice, photographs, video, opinions, statements, hometown, province, state and country for promotional purposes in any manner or media (including, without limitation, online), worldwide, in perpetuity, and without further payment, consideration, notice, review or consent.
10. GENERAL CONDITIONS: Contest Organizer reserves the right, in its sole discretion, to terminate, modify or suspend the Contest, if, in Contest Organizer’s opinion, there is any suspected or actual evidence of tampering with any portion of the Contest, or if viruses, bugs, unauthorized intervention, fraud, technical difficulties or failures or any other factor beyond Contest Organizer’s reasonable control corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest. In such event, Contest Organizer reserves the right (but does not have the obligation) in its sole discretion to award prize at random from among eligible, non-suspect entries received up to the time of suspected impairment. Contest Organizer reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of this Contest may be a violation of criminal and civil laws, and, should such an attempt be made, Contest Organizer reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. Contest Organizer’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision or any other provision of these Official Rules. In the event that an entry is confirmed to have been erroneously deleted, lost or destroyed, entrant’s sole remedy shall be another entry into the Contest. If any provision(s) of these Official Rules is held to be invalid or unenforceable, such provision(s) shall be struck, and the remaining provisions shall be enforced.
11. RELEASE: By entering the Contest, each entrant forever and irrevocably releases and holds harmless Contest Organizer, Intrawest ULC, the Utah Hockey Club, the Delta Center, and each of their parents, subsidiaries and affiliates, and their respective directors, officers, employees, representatives, shareholders, successors-in-interest, and agents (collectively, the “Released Parties”) from any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest or with the acceptance, possession, or use of any prize, (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light). Entrant also agrees to fully indemnify the Released Parties from any and all claims by third parties relating to the Contest.
12. LIMITATIONS OF LIABILITY: The Released Parties are not responsible for: (a) technical failures of any kind, including but not limited to the malfunction of any telephone network or lines, computer online systems, servers, access providers, computer equipment, software, failure of any e-mail entry to be received by Contest Organizer on account of technical problems or traffic congestion on the Internet or any website, or any combination thereof, including any injury or damage to an entrant’s or any other person’s computer, related to or resulting from playing or downloading materials in this promotion; (b) any incomplete or inaccurate information, whether caused by the website users or by any equipment of programming associated with or utilized in the Contest, or by any technical or human error which may occur in the processing of entries; (c) the theft, destruction or unauthorized access to, or alteration of, entries or the website; or (d) any injury or damage to persons or property, including but not limited to entrant’s computer, which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use of any prize, or from viewing, playing or downloading any material from Contest Organizer’s website(s), regardless of whether the material was prepared by Contest Organizer or a third party, and regardless of whether the material is connected to Contest Organizer’s websites by a hypertext link. Contest Organizer reserves the right, in its sole discretion, to cancel, modify or suspend the Contest should a virus or bug or other cause beyond the reasonable control of Contest Organizer or its agents corrupt the security or proper administration of the Contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such an attempt be made, Contest Organizer reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Contest Organizer reserves the right to forbid the framing of any of the contents of this site and, in their sole discretion, to disqualify any individual who tampers with the entry process.
13. DISPUTES: Each entrant agrees that, except to the extent prohibited by law: (a) any and all disputes, claims, and causes of action arising out of or connected with this Contest or any prizes awarded shall be resolved individually, without resort to any form of class action, and solely and exclusively in the Province of Alberta; entrant submits to sole and exclusive personal jurisdiction to said courts in the Province of Alberta for any such dispute and irrevocably waives any and all rights to object to such jurisdiction; (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred in connection with entering this Contest but in no event legal or attorneys’ fees; and (c) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket costs, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant or Contest Organizer in connection with the Contest shall be governed by, and construed in accordance with, the laws of the Province of Alberta, without giving effect to any choice of law or conflict of law rules or provisions (whether of the Province of Alberta, the United States, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Province of Alberta.
14. PRIVACY/DATA COLLECTION: Entrants provide personal information on the entry form when they enter this Contest. Contest Organizer collects this information and uses it to administer this Contest.
When you enter the Contest, you will be given an opportunity to consent to receive marketing and promotional communications from Contest Organizer and/or its affiliates. Consenting to receive such emails and information is optional and is not necessary to enter or win this Contest, nor will it increase or improve your chances of winning.
Contest Organizer may share your personal information with third parties who need access to this information to perform services on Contest Organizer’s behalf. 15. Each of winner and winner’s guest will be responsible for all costs, expenses and incidentals that are not specifically stated as being included in the Prize, including but not limited to, airfare, accommodations before and following the trip, personal items, food, alcohol purchases, CMH shop purchases, gratuities, taxes, and insurance. Each of winner and winner’s guest is responsible for ensuring that he/she has any and all required travel documentation and identification, including passports and visas as applicable, and to ensure that such travel documentation or identification is valid prior to and for the entire duration of travel, and to comply with any customs and immigration requirements. The Prize activities, including, without limitation, heli-skiing, are subject to weather, safety and other similar limitations and restrictions, as well as the duration of the 2024-25 ski season, which may be affected by many factors, including but not limited to, snow conditions, runs open, unusually harsh weather, pandemic or epidemic, travel advisories, public health or government order, or any other event or occurrence, as determined by Contest Organizer in its sole discretion, which may result in limitation of Prize and/or which may limit or prohibit Canadian Mountain Holidays from conducting its operations. In the event of any such impacts on the use of a Prize, no cash or other consideration will be provided to winner, but winner may reschedule his/her use of the Prize to the 2025-26 ski season. No compensation of any kind other than this optional rescheduling will be provided under any circumstances whatsoever and the Prize will expire and be forfeited if no such rescheduling is booked prior to April 15, 2026 and only one (1) such rebooking will be permitted. It is recommended that each of winner and winner’s guest obtain sufficient personal travel insurance prior to departure. If winner and/or winner’s guest decides not to travel due to reasons other than the foregoing, the prize will be forfeited, no alternative prize will be awarded, and no credit or reimbursement will be awarded. Contest Organizer will not replace lost or stolen travel documents.
Prize is nontransferable, nonassignable, nonnegotiable, and not redeemable for cash or credit, except as otherwise provided in these Official Rules. Prize must be accepted as awarded. To the fullest extent permitted by applicable law, the Prize is awarded “AS IS” with no warranty, condition, representation, or guarantee, express or implied, in fact or in law, made by Contest Organizer or for which Contest Organizer shall be liable, including, without limitation, ANY IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, NON-INFRINGEMENT OR FITNESS FOR A PARTICULAR PURPOSE AND WINNER ASSUMES ANY AND ALL RISKS OF USING THE PRIZE, INCLUDING PERSONAL INJURY, PROPERTY DAMAGE OR DEATH. No prize substitutions, except by Contest Organizer, who reserves the right (but has no obligation) to substitute a prize (or a component thereof) with another prize of comparable or greater value (including cash) if the Prize (or a component thereof) is not available for any reason as determined by Contest Organizer in its sole discretion. Unused components of a prize shall be forfeited and have no redeemable cash value. Winner is solely and fully responsible for any and all costs, fees, taxes, assessments and expenses associated with prize award, redemption, receipt and use not specified in the prize description above, including, without limitation, all international, federal, provincial state, and local taxes on such prize. If applicable, winner will be issued an IRS Form 1099 (or Canadian equivalent) for the actual retail value of the Prize. Winner waives the right to assert as a cost of winning a prize any and all costs of verification and redemption or travel to redeem the Prize. Non-compliance with any of the foregoing and any other condition of this Contest may result in disqualification and forfeiture of prize, in which case, no consideration will be awarded.
Prize is also conditional on winner and winner’s guest signing CMH’s standard Release of Liability, Waiver of Claims, Assumption of Risk, Warning, Indemnity and Consent to Medical Treatment Agreement (“Waiver”) no later than 30 days prior to the first day of their trip, after which date winner will forfeit their Prize. Should winner and/or winner’s guest refuse to sign the Waiver prior to the trip, they will be unable to join the trip and they will not be entitled to any other compensation from CMH as a result of such cancellation.
9. PUBLICITY: Except where prohibited by law, acceptance of a prize constitutes a winner’s consent to Contest Organizer’s (and its successors’ and assigns’) use of a winner’s name, biography, likeness, voice, photographs, video, opinions, statements, hometown, province, state and country for promotional purposes in any manner or media (including, without limitation, online), worldwide, in perpetuity, and without further payment, consideration, notice, review or consent.
10. GENERAL CONDITIONS: Contest Organizer reserves the right, in its sole discretion, to terminate, modify or suspend the Contest, if, in Contest Organizer’s opinion, there is any suspected or actual evidence of tampering with any portion of the Contest, or if viruses, bugs, unauthorized intervention, fraud, technical difficulties or failures or any other factor beyond Contest Organizer’s reasonable control corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest. In such event, Contest Organizer reserves the right (but does not have the obligation) in its sole discretion to award prize at random from among eligible, non-suspect entries received up to the time of suspected impairment. Contest Organizer reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of this Contest may be a violation of criminal and civil laws, and, should such an attempt be made, Contest Organizer reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. Contest Organizer’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision or any other provision of these Official Rules. In the event that an entry is confirmed to have been erroneously deleted, lost or destroyed, entrant’s sole remedy shall be another entry into the Contest. If any provision(s) of these Official Rules is held to be invalid or unenforceable, such provision(s) shall be struck, and the remaining provisions shall be enforced.
11. RELEASE: By entering the Contest, each entrant forever and irrevocably releases and holds harmless Contest Organizer, Intrawest ULC, the Event Parties, and each of their parents, subsidiaries and affiliates, and their respective directors, officers, employees, representatives, shareholders, successors-in-interest, and agents (collectively, the “Released Parties”) from any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest or with the acceptance, possession, or use of any prize, (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light). Entrant also agrees to fully indemnify the Released Parties from any and all claims by third parties relating to the Contest.
12. LIMITATIONS OF LIABILITY: The Released Parties are not responsible for: (a) technical failures of any kind, including but not limited to the malfunction of any telephone network or lines, computer online systems, servers, access providers, computer equipment, software, failure of any e-mail entry to be received by Contest Organizer on account of technical problems or traffic congestion on the Internet or any website, or any combination thereof, including any injury or damage to an entrant’s or any other person’s computer, related to or resulting from playing or downloading materials in this promotion; (b) any incomplete or inaccurate information, whether caused by the website users or by any equipment of programming associated with or utilized in the Contest, or by any technical or human error which may occur in the processing of entries; (c) the theft, destruction or unauthorized access to, or alteration of, entries or the website; or (d) any injury or damage to persons or property, including but not limited to entrant’s computer, which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use of any prize, or from viewing, playing or downloading any material from Contest Organizer’s website(s), regardless of whether the material was prepared by Contest Organizer or a third party, and regardless of whether the material is connected to Contest Organizer’s websites by a hypertext link. Contest Organizer reserves the right, in its sole discretion, to cancel, modify or suspend the Contest should a virus or bug or other cause beyond the reasonable control of Contest Organizer or its agents corrupt the security or proper administration of the Contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such an attempt be made, Contest Organizer reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Contest Organizer reserves the right to forbid the framing of any of the contents of this site and, in their sole discretion, to disqualify any individual who tampers with the entry process.
13. DISPUTES: Each entrant agrees that, except to the extent prohibited by law: (a) any and all disputes, claims, and causes of action arising out of or connected with this Contest or any prizes awarded shall be resolved individually, without resort to any form of class action, and solely and exclusively in the Province of Alberta; entrant submits to sole and exclusive personal jurisdiction to said courts in the Province of Alberta for any such dispute and irrevocably waives any and all rights to object to such jurisdiction; (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred in connection with entering this Contest but in no event legal or attorneys’ fees; and (c) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket costs, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant or Contest Organizer in connection with the Contest shall be governed by, and construed in accordance with, the laws of the Province of Alberta, without giving effect to any choice of law or conflict of law rules or provisions (whether of the Province of Alberta, the United States, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Province of Alberta.
14. PRIVACY/DATA COLLECTION: Entrants provide personal information on the entry form when they enter this Contest. Contest Organizer collects this information and uses it to administer this Contest.
When you enter the Contest, you will be given an opportunity to consent to receive marketing and promotional communications from Contest Organizer and/or its affiliates. Consenting to receive such emails and information is optional and is not necessary to enter or win this Contest, nor will it increase or improve your chances of winning.
Contest Organizer may share your personal information with third parties who need access to this information to perform services on Contest Organizer’s behalf.
